Tort law and warranty law

Tort and warranty law is a branch of civil law.

Tort law (liability law) regulates the conditions under which an injured party can claim compensation for damage from someone else.

There can be various reasons why one is an injured party and has claims for damages against someone else or is confronted with claims for damages oneself. These reasons may be, for example, that your contractual partner has not fulfilled his obligations under the contract and you have suffered damage as a result. Other reasons can be of a tortious nature, i.e. that someone has injured you in the course of a traffic accident or sports accident, for example, or has damaged your property, etc.

Warranty is the strict liability of the debtor for defects that his service (or goods) has at the time of performance – e.g. the service of a craftsman you have hired or the car you have bought is defective.
